Terms of Use
Article 1 (Purpose)These terms and conditions are intended to establish the details of the implementation and compliance of domestic travel contracts entered into between KCC Company Travel Agency and travelers.
Article 2 (Types and Definitions of Travel)
The types and definitions of travel are as follows:
1. General Recruitment Travel: Travel conducted by recruiting travelers according to travel conditions established by the travel agency.
2. Desired Travel: Travel conducted by the travel agency according to travel conditions desired by the traveler.
3. Consignment Recruitment Travel: Travel conducted by entrusting the recruitment of travelers for the recruited travel products created by the travel agency to another travel agency.
Article 3 (Obligations of Travel Agencies and Travelers)
① In order to provide safe and satisfactory travel services to travelers, travel agencies must faithfully perform their assigned duties in the process of establishing and executing travel plans, such as travel arrangements, guidance, transportation, and accommodations.
② Travelers must actively cooperate in promoting harmony among travelers and maintaining travel order by the travel agency for safe and enjoyable travel.
Article 4 (Contract Composition)
① The travel contract consists of the travel contract (attached) and travel terms and conditions, travel schedule (or travel brochure).
② The travel contract must include the travel agency's name, location, and subscription to insurance (or deposit status of business guarantee) in accordance with Article 9 of the Tourism Promotion Act.
③ The travel schedule (or travel brochure) must include the travel destination, tourism content, transportation, number of shopping trips, accommodations, meals, etc. for each travel date, as well as the travel schedule and services provided by the travel agency, and traveler's notes.
Article 5 (Refusal to Conclude Contract)
A travel agency may refuse to conclude a contract with a traveler if any of the following reasons apply to the traveler.
1. When individual management is required due to illness, physical abnormality, etc., or when it is recognized that smooth implementation of group travel (such as causing disruption to other travelers’ travel) is impeded
2. When the maximum number of participants specified in the contract is exceeded
Article 6 (Special Agreement)
Travel agencies and travelers may enter into a special agreement in writing (including electronic documents, hereinafter the same) within the scope that does not violate relevant laws and regulations. In this case, the travel agency must explain to the traveler that the contents of the special agreement are different from the standard terms and conditions and take precedence over the standard terms and conditions, and obtain separate confirmation.
Article 7 (Provision of Contracts, etc. and Safety Information)
When a travel agency enters into a travel contract with a traveler, it must provide the traveler with one copy each of the contract, travel terms and conditions, and travel schedule (or travel brochure), and provide safety information regarding the travel destination. In addition, if the safety information for the travel destination has changed before departure, the changed safety information must be provided.
Article 8 (Deemed Delivery of Contract, Terms and Conditions, etc.)
In the following cases, the travel agency is deemed to have delivered the travel contract, terms and conditions, and travel schedule (or travel brochure) to the traveler.
1. If the traveler agrees to the contents of the travel contract, terms and conditions, and travel schedule (or travel brochure) provided through an electronic information network such as the Internet and applies for the conclusion of the travel contract, and the travel agency notifies the traveler of its intention to accept using an electronic information network or mechanical device, etc.
2. If the traveler agrees to the contents of the travel contract, terms and conditions, and travel schedule (or travel brochure) provided by the travel agency through a mechanical device such as a facsimile and sends a written application for the conclusion of the travel contract, and the travel agency notifies the traveler of its intention to accept using an electronic information network or mechanical device, etc.
Article 9 (Travel Fee)
① The travel fee of the travel contract includes the following items. However, the desired travel is subject to the agreement between the parties.
1. Fares for transportation agencies such as airplanes, ships, and railways (standard fares)
2. Shuttle bus fares between airports, stations, docks, and hotels
3. Accommodation and meal fees
4. Guide expenses
5. Various taxes required during the trip
6. Domestic airport and port usage fees
7. Entrance fees to tourist attractions listed on the itinerary
8. Other costs according to individual contracts
② When concluding a contract, the traveler must pay the travel agency a deposit (an amount of 10% or less of the travel fee), and the deposit is treated as all or part of the travel fee or damages.
③ The traveler must pay the travel agency the remaining balance of the travel fee stipulated in Paragraph 1, excluding the deposit, by the day before the departure date.
④ The traveler must pay the travel fee stipulated in Paragraph 1 by card, bank transfer, or bank transfer, as agreed upon by the parties.
⑤ If the desired travel fee includes travel insurance, the travel agency must explain the name of the insurance company, compensation details, etc. to the traveler.
Article 10 (Requirements for Changes to Travel Conditions and Settlement of Fees, etc.)
① Travel conditions specified in the contract, etc. may be changed only in the following cases:
1. When both parties agree that it is unavoidable for the safety and protection of the traveler due to the traveler’s request or local circumstances
2. When the purpose of the trip cannot be achieved due to natural disasters, wars, government orders, strikes, or closures of transportation/accommodation facilities, etc.
② When a travel agency changes the travel schedule specified in the contract, etc., it must obtain the traveler’s written consent before the start of the schedule for the relevant date. In this case, the written consent must include the date and time of the change, the details of the change, and the costs incurred due to the change.
③ When it is deemed difficult to obtain the traveler’s consent to change the travel schedule due to an emergency such as a natural disaster, accident, or kidnapping, the travel agency may not obtain the schedule change consent form pursuant to Paragraph 2. However, the travel agency must explain the reason for the change and the costs, etc. in writing afterward. ④ In the event that the travel fee under Article 9, Paragraph 1 increases or decreases due to a change in the travel conditions under Paragraph 1, the portion changed prior to the departure of the trip must be settled (refunded) before the departure of the trip, and the portion changed during the trip must be settled (refunded) within 10 days after the end of the trip.
⑤ In the event that the travel conditions are changed other than pursuant to Paragraph 1, or that damages arise due to the cancellation or termination of the contract pursuant to Articles 13 to 15, the portion incurred prior to the departure of the trip must be settled (refunded) before the departure of the trip, and the portion incurred during the trip must be settled (refunded) within 10 days after the end of the trip.
⑥ If a traveler fails to receive services included in the travel fee, such as accommodation, meals, or sightseeing, due to his/her own circumstances after the departure of the trip, he/she cannot claim a refund of the corresponding fee from the travel agency. However, if the trip is terminated midway, it will be processed in accordance with Article 15.
Article 11 (Transfer of Traveler Status)
① In order for a traveler to transfer his/her status due to personal reasons, etc., he/she must obtain the approval of the travel agency. At this time, the travel agency may accept the transfer on the condition that the traveler or the person to whom the traveler's status is transferred shall pay the costs incurred from the transfer.
② If there are costs incurred from the transfer in the preceding paragraph, the travel agency shall request payment of such costs within a specified period.
③ The travel agency may not accept the transfer in the first paragraph due to reasons such as contract terms or unavoidable circumstances that make the transfer difficult.
④ The transfer in the first paragraph shall take effect when the travel agency accepts it. However, if the travel agency accepts the transfer on the condition that the costs incurred from the transfer be paid, the transfer shall take effect as soon as the costs are paid within the specified period.
⑤ If the traveler's status is transferred, all of the traveler's rights and obligations related to the travel contract shall be transferred to the person to whom the status is transferred.
Article 12 (Responsibility of the travel agency)
① If there is a defect in the travel, the traveler may request the travel agency to correct the defect or reduce the price. However, if the correction would cost too much or correction cannot be reasonably expected, the correction may not be requested. ② Travelers may claim compensation in lieu of a claim for correction or reduction, or may claim compensation together with a claim for correction or reduction.
③ The rights in Paragraphs 1 and 2 may be exercised during the travel period, and must be exercised within 6 months from the end of the travel period.
④ The travel agency shall be liable if the travel agency itself or its employees, local travel agencies or its employees (hereinafter referred to as “employees”) intentionally or negligently inflict damage on the traveler in relation to the travel agency’s duties as stipulated in Article 3, Paragraph 1 from the time of departure to the time of arrival.
⑤ The travel agency shall compensate for damages suffered by the traveler due to delays in the departure or arrival of transportation such as aircraft, trains, or ships, or traffic congestion. However, this shall not apply if the travel agency proves that there was no intent or negligence. ⑥ The travel agency shall compensate for damages caused by loss, damage, or delay of the traveler’s baggage unless the travel agency proves that it or its employees did not neglect to take care in receiving, delivering, or storing the traveler’s baggage.
Article 13 (Cancellation of Contract before Departure)
① The travel agency or traveler may cancel this travel contract before departure. In this case, the amount of damages incurred shall be compensated in accordance with the ‘Consumer Dispute Resolution Standards’ (Fair Trade Commission Notice).
② The travel agency or traveler may cancel this travel contract without paying the damages in Paragraph 1 to the other party if any of the following reasons apply before departure.
1. Cases in which the travel agency may cancel
A. Cases in Article 10, Paragraph 1, Subparagraphs 1 and 2
B. When the traveler is deemed to have caused inconvenience to other travelers or significantly hindered the smooth operation of the trip
D. If the traveler is unable to participate in the trip due to illness or other physical abnormalities in the traveler
D. If the traveler does not pay the travel fee by the due date stated in the contract
2. Cases in which the traveler may cancel
A. In the case of reasons in Article 10, Paragraph 1, Subparagraphs 1 and 2
B. If the travel agency has not subscribed to the insurance or guarantee insurance pursuant to Article 18 or has not deposited the business guarantee
C. If the traveler's third degree relative or closer dies
D. If the traveler is unable to participate in the trip due to illness or other physical abnormalities in the traveler
E. If the spouse or direct ascendant is hospitalized in a hospital (clinic) for more than 3 days due to a physical abnormality and is difficult to discharge by the time of the trip, one spouse or guardian
F. In the event that the travel agency is at fault and the travel schedule stated in the contract becomes impossible,
Article 14 (Cancellation of contract when minimum number of participants is not met)
① In the event that the travel agency cancels the travel contract because the minimum number of participants is not met, the travel agency must notify the traveler at least 24 hours before departure for a same-day trip, and at least 48 hours before departure for a trip of 1 night and 2 days or more.
② In the event that the travel agency cancels the contract without notifying the traveler within the period stated in the preceding paragraph due to a lack of participants, the payment has already been made.
